Terms Of Use

Welcome to the Presbyterian Foundation Group’s ymiLIVE site (the “ymiLIVE site”). The ymiLIVE site is operated by the Presbyterian Foundation (the “Foundation”). By accessing or using the ymiLIVE site, you (the “User”) signify that you have read, understand and agree to be bound by these Terms of Use (“Terms of Use” or “Agreement”), whether or not you are a registered member of the ymiLIVE site.

We may change, modify, add, or delete portions of these Terms of Use at any time without further notice. If we do this, we will post the changes to these Terms of Use here and will indicate at the top of this page the date these terms were last revised. Your continued use of the ymiLIVE site after any such changes constitutes your acceptance of the new Terms of Use. Check the Site regularly to determine if there have been changes to these Terms of Use and review such changes.

PLEASE READ THESE TERMS OF USE CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR RIGHTS, REMEDIES AND OBLIGATIONS.

Eligibility


Must be a Youth Group affiliated with the Presbyterian Church (U.S.A.)

Age Restriction: Users who are younger than thirteen (13) years of age must provide valid and current contact information for a parent or legal guardian when registering for the ymiLIVE site or confirming a registration submitted by a Group Leader (see Group Registration below). By using the ymiLIVE site, you affirm that 1) you are 13 or older, OR 2) you have provided valid and current contact information for a parent or legal guardian during the registration process.

Parental Opt-Out: If you are under thirteen (13) years of age, we may use the parent or guardian contact information you provided to notify your parent or guardian about your registration. If your parent or guardian tells the Foundation that you should not be permitted to participate, we may terminate your registration. Parents have the right to revoke consent at any time.


Group Leader Eligibility: Group Leaders (see Group Registration below) must be eighteen (18) years of age or older, and must be leaders of a bona fide youth group associated with the Presbyterian Church (U.S.A.) (“Youth Group”). By using the ymiLIVE site as a Group Leader or by submitting a Group Registration, you represent and warrant that you are 18 or older, and that you are the leader of a Youth Group on whose behalf you are submitting the Group Registration.

Group Registrations


Pastors, youth pastors, youth group leaders, or other persons (“Group Leaders”) may submit a Group Registration for the ymiLIVE site on behalf of members of a bona fide youth group associated with the Presbyterian Church (U.S.A.) (“Presbyterian Youth Group”). Group Registrations enable additional features on the ymiLIVE site for group members, such as the ability to obtain access to and/or modify User Content associated with the group (“Group Access Rights”).

We may reject a Group Registration, or terminate an existing Group Registration, if the Foundation is unable to confirm that the Group Registration represents a Youth Group, or that the Group Leader is ineligible under these Terms of Use. We may also terminate any user’s Group Access Rights if the Foundation determines, in its sole discretion, that the user is not a bona fide member of the group. An active Group Registration does not constitute any recognition or endorsement by the Foundation that the group is a bona fide Presbyterian Youth Group.

Group Leader Rights and Responsibilities: If you are a Group Leader, you may be permitted to register members of the Youth Group as individual users of the ymiLIVE site. You may also be permitted to add or remove Group Access Rights for an individual user. You also agree to maintain and promptly update the list of individual users with Group Access Rights in accordance with any changes in membership in the Youth Group. You also agree not to transfer your Group Leader position to any ineligible person.

Registration Data; Account Security


You agree to (a) provide accurate, current and complete information as required when you register (“Registration Data”); (b) maintain the security of your password and identification (“Credentials”); (c) maintain and promptly update your Registration Data to keep it accurate, current and complete; and (d) be fully responsible for all use of your account and Credentials, and for any actions that take place using your account.

If your registration for the ymiLIVE site was submitted as part of a Group Registration, you agree to verify and correct any information about you that may have been provided by the Group Leader. If you are no longer a member of the Presbyterian Youth Group in which you currently have Group Access Rights, you agree to terminate your access rights.

User Conduct


You understand that you may use the ymiLIVE site for your personal, non-commercial use only. You may not upload, post, transmit, share, store, or otherwise make available:

  • content that is harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;
  • materials of any kind that violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or that contain libelous, defamatory or otherwise unlawful material;
  • videos other than those that are your original work and/or the original work of a Presbyterian Youth Group to which you belong;
  • advertising, solicitations, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation;
  • material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  • private information belonging to or about any third party, except by a Group Leader in connection with a Group Registration.

In addition, you may not:


  • use the ymiLIVE site in any unlawful manner or in any other manner that could damage, disable, overburden or impair the ymiLIVE site;
  • intimidate or harass another person;
  • register for more than one User account, register for a User account on behalf of an individual other than yourself or create a false user identity, use another’s account, or, unless you are a Group Leader, register for a User account on behalf of any group or entity;
  • use automated scripts to collect information from or otherwise interact with the ymiLIVE site;
  • collect and/or use other users’ email addresses or other contact information to send unsolicited emails or other unsolicited communications;
  • solicit personal information from anyone under 18 except by a Group Leader in connection with a Group Registration, or solicit passwords or personally identifying information for commercial or unlawful purposes.

Without limiting any of the foregoing, you also agree to abide by our ymiLIVE site Community Guidelines that provide further information regarding the authorized conduct of users.
We may, but are not obligated to, monitor theymiLIVE site to ensure compliance with our policies. The Foundation reserves the right to remove any content that it may deem, in its sole discretion, to be in violation of the principles of the Presbyterian Church (U.S.A.) or the Foundation.


User Disputes & Abuse


You are solely responsible for your interactions with other ymiLIVE site users. We reserve the right, but have no obligation, to monitor disputes between you and other users. We also reserve the right, but have no obligation, to report instances of abuse of the ymiLIVE site, or of other users, to Group Leaders or to law enforcement in our sole discretion.

Termination and Removal of Content


The Foundation may terminate your membership, delete your profile and any content or information that you have posted on the Site and/or prohibit you from using or accessing the ymiLIVE site (or any portion, aspect or feature of the ymiLIVE site) for any reason, at any time in its sole discretion, with or without notice.

User Content Posted on the ymiLIVE site


You are solely responsible for the photos, profiles, messages, notes, text, information, music, video, and other content that you upload, publish or display on or through the ymiLIVE site, or transmit to or share with other users (collectively the “User Content”). You are solely responsible for creating your own backup copies and replacing any User Content you post or store on the ymiLIVE site or provide to the Foundation.

Foundation’s License to User Content: By posting User Content on the ymiLIVE site, you automatically grant, and you represent and warrant that you have the right to grant, to the Foundation an irrevocable, perpetual, non-exclusive, transferable, royalty-free, worldwide license (with the right to sublicense) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such User Content for any purpose on or in connection with the ymiLIVE site, the Presbyterian Church (U.S.A.) or the Presbyterian Foundation or its affiliates, or the promotion thereof, to prepare derivative works of, or incorporate into other works, such User Content, and to grant and authorize sublicenses of the foregoing. You may remove your User Content from the ymiLIVE site at any time. Removing your User Content does not, however, terminate this license and the rights under it described above.

Contest Submissions: From time to time, the Foundation may hold competitions or contests involving submissions of User Content. When you submit User Content for a competition, you agree to relinquish any ownership rights in that User Content to the Foundation, including the right to use, modify, publicly perform, publicly display, reproduce, and distribute any such content. Please note that particular competitions or contests may have specific rules that supplement or supersede these rules.

Other Submissions: You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the ymiLIVE site (“Submissions”), provided by you to the Foundation are non-confidential and shall become the sole property of the Foundation. The Foundation shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

Proprietary Rights in Site Content; Limited License


Ownership of Site Content: All content available through the ymiLIVE site, including but not limited to designs, text, graphics, pictures, video, information, applications, software, music, sound and other files, and their selection and arrangement (the “Site Content”), are the proprietary property of the Foundation, its users or its licensors with all rights reserved. Except as explicitly set forth in these Terms of Use, you may not modify, copy, distribute, frame, reproduce, republish, download, display, post, transmit, or sell the Site Content in any form or by any means, in whole or in part, without the Foundation’s prior written permission, except that the foregoing does not apply to your own User Content (as defined above) that you legally post on the ymiLIVE site.

Limited License for Site Content: Provided that you are eligible for use of the ymiLIVE site, you are granted a limited license to access and use the ymiLIVE site and the Site Content and to download or print a copy of any portion of the Site Content to which you have properly gained access solely for your personal, non-commercial use, provided that you keep all copyright or other proprietary notices intact. Except for your own User Content, you may not upload or republish Site Content on any Internet, Intranet or Extranet site or incorporate the information in any other database or compilation, and any other use of the Site Content is strictly prohibited. Such license is subject to these Terms of Use and does not include use of any data mining, robots or similar data gathering or extraction methods.

Any use of the ymiLIVE site or the Site Content other than as specifically authorized herein, without the prior written permission of the Foundation, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws including without limitation copyright and trademark laws and applicable communications regulations and statutes. This license is revocable at any time without notice and with or without cause.

Privacy


We care about the privacy of our users. Click here to view the ymiLIVE site Privacy Policy. By using the ymiLIVE site, you are consenting to have your personal data transferred to and processed in the United States.

Copyright Policy


If you believe that your work has been copied and posted on the ymiLIVE site in a way that constitutes copyright infringement, please provide the following information: (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (ii) a description of the copyrighted work that you claim has been infringed; (iii) a description of where the material that you claim is infringing is located on the ymiLIVE site; (iv) your address, telephone number, and email address; (v) a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. Disclaimers


Limitation on Liability for Content and Conduct: The Foundation is not responsible or liable in any manner for any User Content, whether posted or caused by users of the ymiLIVE site, by the Foundation, by third parties or by any of the equipment or programming associated with or utilized in the ymiLIVE site. Although we provide rules for user conduct and postings, we do not control and are not responsible for what users post, transmit or share on the ymiLIVE site and are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content you may encounter on the ymiLIVE site or in connection with any User Content. The Foundation is not responsible for the conduct, whether online or offline, of any user of the ymiLIVE site.

Limitation on Liability for Loss or Damage: Under no circumstances will the Foundation be responsible for any loss or damage, including any loss or damage to any User Content or personal injury or death, resulting from anyone's use of the ymiLIVE site, any User Content posted on or through the ymiLIVE site or transmitted to Users, or any interactions between users of the ymiLIVE site, whether online or offline. You understand and agree that you download or otherwise obtain content, material, data or software from or through the ymiLIVE site at your own discretion and risk and that you will be solely responsible for your use thereof and any damages to your mobile device or computer system, loss of data or other harm of any kind that may result.

General Limitation on Liability: In no event will the Foundation or its directors, employees or agents be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including for any lost profits or lost data arising from your use of the ymiLIVE site or any of the Site Content or other materials on, accessed through or downloaded from the ymiLIVE site, even if the Foundation is aware or has been advised of the possibility of such damages. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages; if these laws apply to you, some or all of the above disclaimers, exclusions or limitations may not apply to you, and you may have additional rights.

The Foundation reserves the right to change any and all content, software and other items used or contained in the ymiLIVE site at any time without notice. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, and supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof, or any affiliation therewith, by the Foundation.
